Policy (Terms and Conditions)
I.INTRODUCING TOEE TIRE VIP POINTS, AND REWARD COUPONS
The Toee Tire dealer VIP program (“VIP Program” or “Dealer Program”) is a rewards program offered by Toee Tire North America Inc., and its affiliate “Toee Tire”, “us” or “Ours” in Canada. This Member Agreement, as well as all additional policies, terms and conditions referenced and incorporated throughout, all of which may be amended from time-to-time (collectively, the “Terms”), contain information about the relationship between you and Toee Tire with respect to the program.
II.GENERAL
By enrolling in, accessing, or otherwise participating in, the Program, you acknowledge that you have read, understood and unconditionally accept to be bound by the Terms. Toee Tire reserves the right to modify these Terms, without further notice or compensation to you, and you waive any right to receive specific individual notice of such modifications. Any updates to these Terms will be effective immediately upon posting at toeetire.com/pages/rewards-page and your continued participation in the Program constitutes your acceptance to such modifications. These Terms constitute a legally binding agreement between Toee Tire and each business who enrolls or otherwise participates in the Program. Accordingly, you expressly represent and warrant that you are eligible for the Program (as described below) and will otherwise comply with these Terms. If you do not agree to all of the Terms now or at any point in the future or you become ineligible for the Program, please contact us at 905-337-8266 ext 1001 to opt out. These Terms do not alter in any way the terms and conditions of any other agreement you may have with Toee Tire for other products or services, including the VIP Customer Agreement, and the VIP Customer Program, or Toee Tire’s Policies and Procedures. Our Privacy Policy is incorporated into these Terms and Conditions and also governs your participation in VIP Points. Please read the Privacy Policy carefully to understand how Toee Tire collects, uses, and discloses information about customers, how to update or change your personal information, and how we communicate with you.
III. ELIGIBILITY
The Program is only open to all automobile related business that located in Canada where Toee Tire conducts business and is an existing Toee Tire VIP Customer. Effective March 31, 2022
- General.
- Each Toee Tire VIP Dealers is limited to one Program account, and only one Program account may be associated with a single email address.
- Bulk order discount or existing promotion discount products will not generate VIP Points
- Your VIP Points and Reward Coupons cannot be transferred, traded, auction, or sold.
- VIP Points is intended for the business use only. Personal use is prohibited.
- Individual or other entities are ineligible to participate in the Program. Toee Tire may disqualify any such entity discovered to be in the Program, which may include forfeiture of previously issued but unused rewards, discounts, or coupons.
- ENROLLMENT
- The following dealers will be automatically enrolled into the Program on March 31, 2022:
(1) Existing VIP Customers who have an active discount.
(2) VIP Customers who have fulfilled the orders in the past year (annual spending of CAD $1,000 or more).
- All purchases prior to March 31, 2022, will not be counted towards or applied to the VIP Points.
- ABOUT VIP POINTS
VIP Points is one way in which Toee Tire endeavors to reward and thank loyal VIP Customers for patronizing our business and purchasing Toee Tire products.
Toee Tire VIP Customers can earn and accumulate “Points” that can be converted into coupon at a ratio of 100 points to $1
- Minimum Reward coupon redeem amount: There is minimum qualifying purchase of 1,000 points required to redeem a $10 Reward Coupon at least 1,000 points per redemption
Final costs of Qualifying Purchases of a Regular Order are calculated after all discounts are applied. Purchases of a Flash Sales and Promotions do not qualify for the redemption. If Toee Tire products from a Qualified Purchase that earns VIP Points is subsequently returned or price adjusted, the balance of the VIP Points previously earned will be reduced to reflect any unearned value. The previously earned Reward Coupon is non-refundable.
- VIP Points Member Tiers: All Tiers will benefit from the following:
- VIP Level (Tier 1): If a Program Member spends CAD $1,500 in a twelve (12) month period, they may qualify to: (a) Every dollar spend will receive 1 point (b) receive bonus points for select Flash Sales and Promotions.
- VIP + Level (Tier 2): If a Program Member spends CAD $7,500 or more in a twelve (12) month period, the Program Member will advance to a Tier 2, also referred to as “VIP + Member” and may qualify to: (a) Every dollar spend will receive 2 points; (b) receive bonus points for select Flash Sales.
- VIP + Level (Tier 3): If a Program Member spends $15,000 or more in a twelve (12) month period, the Program Member will advance to a Tier 3, also referred to as “VIP + Member” and may qualify to: (a) Every dollar spend will receive 3 points; (b) receive bonus points for select Flash Sales.
- VIP + Level (Tier 4): If a Program Member spends CAD $45,000 or more in a twelve (12) month period, the Program Member will advance to a Tier 4, also referred to as “VIP + Member” and may qualify to: (a) Every dollar spend will receive 4 points; (b) receive bonus points for select Flash Sales.
- VIP + Level (Tier 5): If a Program Member spends CAD $80,000 or more in a twelve (12) month period, the Program Member will advance to a Tier 5, also referred to as “VIP + Member” and may qualify to: (a) Every dollar spend will receive 5 points; (b) receive bonus points for select Flash Sales.
- VIP + Level (Tier 6): If a Program Member spends CAD $100,000 or more in a twelve (12) month period, the Program Member will advance to a Tier 6, also referred to as “VIP + Member” and may qualify to: (a) Every dollar spend will receive 6 points; (b) receive bonus points for select Flash Sales.
- VIP Points Earn Rate: Toee Tire VIP Customers can earn VIP Points at the rate of $1 for every 1 Point times by VIP multiplier earned on all Qualifying Purchases.
- VIP Points can be in “pending status” for up to 48 – 72 hours, to allow for proper processing and shipment of a purchase.
- VIP Points are equal to one Canadian Dollar VIP Customer Discount, and other accumulated promotional discount(s).
- VIP Points will reset on the date of your VIP Customer account renewal from the point in which a VIP Customer enrolls into the Program.
- There is no limit to the number of points that can be earned.
VII. VIP Points Issued or Balance Carry-Forward: VIP Points will not be expired until the account got cancelled or being de-activated. The remaining points cannot be transferred, sold or auction. The Rewards Dashboard is made available by logging into your TOEE TIRE VIP Customer account profile.
VIII. Reward Coupon Redemptions:
- Each activated and issued Reward Coupon can be redeemed only during its stated redemption window listed in your Rewards Dashboard. The redemption window for the Reward Coupon will be 90 days from issuance of the Reward Coupon (“Redemption Window”). Any Reward Coupon that is unused in the VIP Customer’s Rewards Dashboard will expire after that redemption window. The redemption window for your Reward Coupon and other coupon details may be found on the Rewards Dashboard and other communications issued by TOEE TIRE. The Reward Coupon and other dollar-off discounts will be applied after total purchase of discounts.
- A Reward Coupon may be Redeemed by copying an individualized coupon code generated in the Rewards Dashboard.
- Reward Coupons may not be redeemed (1) to purchase TOEE TIRE Gear merchandise; (2) to purchase cause merchandise or other charitable items, such as TOEE TIRE Gratitude; (3) as price adjustments on prior purchases; (5) to pay for any services or fees, including taxes, shipping and handling, or Cancellation Fees; (6) if VIP Customer account is canceled, or terminated; (7) a VIP Customer upgrades their account to a Market Partner account; (8) if combined with other Reward Coupons or discount coupons.
- If TOEE TIRE products purchased earning Reward Coupons and VIP Points are subsequently returned or price adjusted, the value of the VIP Points previously earned and/or the amount of the Product refund will be reduced to reflect any unearned value. Return value or merchandise purchased with Reward Coupons may be subject to adjustment.
- Reward Coupons may not be exchanged or returned for another product or service or reimbursement. If you return products in whole or in part and VIP Points were applied to your order, you may only receive a VIP Points for the portion of the purchase in which you paid for. The VIP Points of such order will be removed from your Rewards Dashboard and cannot be reused.
- Only one Reward Coupon can be applied per Regular Order.
- Reward Coupon is non-transferable.
- Reward Coupon terms are subject to change at any time.
- OTHER PROGRAM FEATURES & BENEFITS
- Offers: Members will receive several special offers throughout a twelve (12)-month period. Offers may include, but are not limited to, percent-off and dollar-off coupons. Offers under the Program are only available while supplies last. TOEE TIRE may make substitutions of offers, in its sole discretion, without the requirement to match or exceed a prior offer.
- Limited Time Promotions: TOEE TIRE may, in its sole discretion, run special limited time promotions available only to VIP Customers, or select members within this group.
- Other Benefits: TOEE TIRE may, in its sole discretion, provide additional Program features and benefits to VIP Customers, whether made available for a limited time or on a consistent basis.
- PROGRAM ACCOUNT ACCESS & MEMBER COMMUNICATIONS
You may access the Program and view your membership activity and VIP Points balance, as well as view the most current Program information and these Terms and Conditions, at toeetire.com/pages/rewards-page and through your TOEE TIRE VIP Customer account page. By enrolling, accessing or otherwise participating in the Program, you agree to receive transactional emails and promotional email offer updates from TOEE TIRE. Program Members may unsubscribe from promotional emails at any time via the unsubscribe link in those emails; provided, however, if you unsubscribe from TOEE TIRE’s promotional e-mails, you may no longer receive those Program benefits which are distributed by email. - PROGRAM MODIFICATION AND TERMINATION
The Program, its benefits, and the interpretation or application of its Terms are offered at the sole discretion of TOEE TIRE. TOEE TIRE reserves the right to modify the Program and any of its terms, features, or benefits at any time with or without notice to you (including without limitation, the rate at which VIP Points or Reward Coupons can be earned). The Program has no predetermined termination date and may continue until such time as TOEE TIRE elects, in its sole discretion, to terminate the Program. TOEE TIRE reserves the right to add, remove, modify, or otherwise change promotional opportunities at any time, in its sole discretion, with or without notice to any Program Member.
XII. TOEE TIRE PROGRAM ACCOUNT CLOSURE
TOEE TIRE may, in its sole discretion, close any VIP Customer accounts enrolled in the Program (“Program Member” or “Program Account”) as it deems, in its sole discretion, inactive. Inactive VIP Points and Reward Coupons may include, without limitation, those Program accounts which have not been used to purchase products within the preceding twelve (12) consecutive months. Program Members who desire to close their account may do so by calling TOEE TIRE Customer Care at 905-337-8266 ext 1001. In addition, TOEE TIRE may close any Program account or membership, if a Program Member becomes ineligible at any time or if any of these Terms are violated, including if the Program account appears to be used for a commercial purpose such as re-sale or if the Program Member’s account is otherwise associated with abusive or fraudulent activity. In the event of such Term(s) violation, TOEE TIRE reserves the right to invalidate improperly awarded or issued VIP Points or Reward Coupons to close your member account altogether and disqualify you from participation of the Program. If you cancel your Program account or it is cancelled by TOEE TIRE, your accumulated earned VIP Points and Reward Coupon balance will be deactivated and invalidated. TOEE TIRE is not responsible for any rewards lost due to such impropriate activity.
XIII. ADDITIONAL TERMS:
(A) Entire Agreement: You agree to comply with Terms of this Membership Agreement, as well as the terms and conditions of the following (all of which are referred to as “Terms” in Section II of this Membership Agreement): (i) TOEE TIRE’s Privacy Policy (referenced below); (ii) TOEE TIRE’s Legal Notices; (iii) any and all other policies and rules as set forth in Program materials, either in print or on the Program web site or any TOEE TIRE applications (apps). New Terms may be added, or existing Terms may be amended from time-to-time. The Terms, as so amended, will be posted on the Program web site or your account back-office, and your continued participation in the Program thereafter will constitute acceptance of all such updated terms.
(B) Privacy Policy: By enrolling or otherwise participating in the Program, you acknowledge and agree that the information you provide as a member of the Program will be released to TOEE TIRE affiliates as well as third parties to carry out the Program on TOEE TIRE’s behalf and will otherwise be handled in accordance with TOEE TIRE’s Privacy Policy.
(C) Trademarks: “TOEE TIRE”, as well as related product and service names, design marks and slogans, are registered trademarks of Toee Tire North America Inc.
